1. Acceptance of terms

By accessing or using Claw Mart, you agree to be bound by these Terms of Use. If you do not agree to these Terms, you must not access or use the platform.

2. Platform overview

Claw Mart is a marketplace that connects buyers with independent creators who publish AI workers, skill packs, plugins, and related digital goods (collectively, "Listings").

Claw Mart provides the platform infrastructure for listing, discovery, purchase, and delivery. Unless explicitly stated otherwise, we are not the creator, publisher, seller, copyright owner, or licensor of individual Listings. Each creator is solely responsible for the content, functionality, legality, and rights associated with their own Listings.

3. Eligibility and account registration

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use Claw Mart.

To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information, and to keep that information updated. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your login credentials.

4. Purchases and payments

All Listings are delivered digitally.

Except where required by applicable law, all purchases are final and non-refundable.

Unless otherwise stated in the applicable Listing terms, a purchase grants the buyer a limited, non-exclusive, non-transferable license for personal or internal business use only. Purchased Listings may not be redistributed, resold, sublicensed, shared, republished, or otherwise made available to third parties except as expressly permitted by the creator or the applicable license terms.

Creators are responsible for setting pricing, usage scope, and any Listing-specific license terms. We may process payments on behalf of creators and may deduct platform fees, payment processing fees, taxes, refunds, chargebacks, or other applicable amounts before remitting any creator payout.

5. Creator responsibilities

If you publish or sell a Listing on Claw Mart, you represent and warrant that:

• You own or have all necessary rights, licenses, permissions, and authority to publish, license, and sell the Listing.
• Your Listing does not infringe, misappropriate, or otherwise violate any third-party rights, including intellectual property, privacy, publicity, confidentiality, or contractual rights.
• Your Listing description, screenshots, documentation, and claims are accurate and not misleading.
• Your Listing does not contain malware, malicious code, hidden payloads, or other harmful components.
• Your Listing complies with all applicable laws, regulations, and platform policies.

Creators are solely responsible for their Listings, including performance, compatibility, documentation, support promises, legal compliance, and any disputes arising from their use or sale.

6. Buyer responsibilities

As a buyer, you are responsible for reviewing the Listing description, documentation, compatibility requirements, and license scope before making a purchase.

You are responsible for ensuring that your use of any purchased Listing complies with the applicable license terms, applicable laws, and any third-party platform or model restrictions that may apply to your intended use.

You acknowledge that some Listings may require technical knowledge, third-party tools, API keys, software environments, or external services in order to function as intended.

7. Platform role and third-party content disclaimer

All Listings on Claw Mart are created, uploaded, and published by independent third-party creators.

We do not routinely review, endorse, certify, verify, monitor, or guarantee any Listing, creator, description, claim, output, result, or promised performance. We are not responsible for:

• The accuracy, quality, safety, legality, usefulness, or functionality of any Listing.
• Any bugs, downtime, incompatibility, security issue, failure, or performance issue in any Listing.
• Any damage, loss, liability, or claim arising from the download, installation, deployment, or use of any Listing.
• Any intellectual property infringement, misrepresentation, or unlawful conduct by a creator.
• Any interaction, transaction, agreement, or dispute between a buyer and a creator.

8. Prohibited conduct

When using the platform, you may not:

• Upload, publish, distribute, or transmit malware, malicious code, exploits, harmful payloads, or content intended to disrupt systems, networks, or data.
• Impersonate any person, company, brand, or organization, or falsely suggest affiliation, sponsorship, or endorsement.
• Publish stolen, plagiarized, deceptive, infringing, or unauthorized content.
• Misuse, probe, test, or bypass platform security, payment systems, account protections, or access controls.
• Use the platform for any unlawful, fraudulent, abusive, or deceptive purpose.
• Manipulate reviews, ratings, downloads, sales metrics, or platform activity.
• Create multiple accounts to evade restrictions, enforcement actions, or platform rules.
• Scrape, copy, reproduce, reverse engineer, or exploit platform content or services except as permitted by law or by our written authorization.
• Interfere with the normal operation of the platform or the experience of other users.

We may investigate suspected violations and may suspend, remove, restrict, or terminate access to accounts or Listings at our discretion.

9. Intellectual property

The Claw Mart platform, including its branding, design, site content, interface elements, software, and related materials, is owned by or licensed to us and is protected by applicable intellectual property laws.

Except for the limited rights expressly granted under these Terms, nothing in these Terms gives you any ownership or license rights in the platform itself.

Creators retain ownership of their Listings, subject to any rights necessary for Claw Mart to host, display, promote, distribute, and operate the marketplace. By submitting a Listing, a creator grants us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, market, distribute, and make the Listing available through the platform for marketplace operations.

10. Account suspension and termination

We may suspend, restrict, or terminate your account, remove Listings, delay payouts, or limit access to any part of the platform at any time, with or without notice, if we believe you have violated these Terms, created legal or security risk, engaged in abuse or fraud, or otherwise exposed the platform or its users to harm.

You may stop using the platform at any time. Termination of your account does not automatically entitle you to a refund for prior purchases unless required by law.

Sections that by their nature should survive termination will continue in effect, including sections relating to licenses, disclaimers, limitation of liability, indemnification, payments, intellectual property, and dispute-related provisions.

11. Warranty disclaimer

The platform and all Listings are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise.

To the maximum extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, compatibility, or satisfactory quality.

We do not guarantee that the platform will be uninterrupted, error-free, secure, or available at all times, or that any Listing will function as described, meet your expectations, or be suitable for your intended purpose.

12. Limitation of liability

To the maximum extent permitted by law, Claw Mart and its operators, affiliates, personnel, contractors, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, data, goodwill, or opportunity, arising out of or related to your use of, or inability to use, the platform or any Listing, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to these Terms, the platform, or any Listing will not exceed the greater of:

• The total amount you paid to us through the platform during the 12 months preceding the event giving rise to the claim.
• RMB 700.

Some jurisdictions do not allow certain exclusions or limitations of liability, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Claw Mart and its operators, affiliates, personnel, contractors, service providers, and licensors from and against any claims, demands, actions, proceedings, damages, losses, liabilities, judgments, costs, and expenses, including reasonable legal fees, arising out of or related to:

• Your use of the platform.
• Your violation of these Terms.
• Any Listing you create, publish, sell, license, distribute, or promote.
• Your violation of any law, regulation, or third-party right.
• Any dispute between you and another user, buyer, creator, or third party.

14. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the platform will be subject to the exclusive jurisdiction of the courts located in Hong Kong, unless otherwise required by applicable law.

15. Changes to these Terms

We may update these Terms from time to time.

If we make material changes, we may provide notice through the platform, by email, or by other reasonable means. The updated Terms will become effective once posted, unless otherwise stated.

Your continued use of Claw Mart after the updated Terms take effect means you accept the revised Terms.
